Florida Lawmakers Push for More Humane Treatment of Florida Inmates with Refiled Bill

Florida Representative Dianne Hart (D–Tampa) is once again fighting for the rights of incarcerated people with the refiling of her Treatment of Inmates bill, a measure aimed at improving living conditions and ensuring fair treatment within Florida’s prison system.

House Bill 55 would require that every inmate in state correctional facilities receive a written copy of their rights, guarantee access to proper ventilation and medical care, and update the definition of “permanently incapacitated inmate” to make it easier for those in severe medical conditions to qualify for conditional release. The proposal also creates a legal pathway for inmates to seek justice if their rights are violated.

Rep. Hart, who has been a consistent voice for prison reform and criminal justice fairness, said the bill is about restoring humanity to a system that too often overlooks it.

Something has to be done about the injustices our loved ones are facing regarding medical treatment,” Hart said in a statement. “For far too long, those that have been employed to assist have turned a blind eye, and, in some cases, that resulted in an inmate’s demise. House Bill 55 is a critical step toward ensuring that every person within our correctional system is treated with fairness, humanity, and respect.”

Hart emphasized that giving inmates the ability to take legal action when their rights are violated is a key safeguard against abuse and neglect.

The measure has backing from Senator Rosalind Osgood (D–Tamarac), who said the legislation represents a push toward a more compassionate justice system.

“Treatment of Inmates is a step toward a more humane and just correctional system,” Osgood said in a press statement. “By ensuring access to necessities like health supplies, proper food, ventilation, and medical justice, we fight to challenge the fatal stigma that incarcerated individuals are undeserving of human dignity and proper care.”

Both Hart and Osgood say they hope this bill will help move Florida toward a more rehabilitative approach to incarceration — one that treats people with dignity, even behind bars. The issue of prison reform continues to impact many Black and Brown Floridians, making this bill one to watch this legislative session.
